Summary

This is a proposed consumer class action against Freedom Mobile Inc. (“Freedom Mobile”) arising out of Freedom Mobile’s practice of rounding up the final minute of wireless call airtime to the next full minute rather than charging for the actual amount of airtime consumed (the “Rounding-Up Practice”), in violation of Freedom Mobile’s service agreement and the terms of the plans that it offers to consumers. This action claims that the Rounding-Up Practice constitutes a breach of Freedom Mobile’s contracts with its customers and of various consumer protection legislations, and had the effect of unjustly enriching Freedom Mobile to the detriment of its customers.

Class Membership Criteria

This class action is brought on behalf of:

  • All individuals who were residents of Canada and, at any time since April 5, 2016, were customers of Freedom Mobile’s wireless services pursuant to either a Prepaid Plan or a Monthly Plan (as defined in the claim), primarily for personal, family or household purposes, other than certain excluded persons.
